The witness owns a dirt contracting business, and he subs out his work to other independents at times. The woman lawyer asks him if he has a duty to drug-test and check the liability insurance of the subs.
Q Did you ask X or Y if they were using any prescription medications or anything that might impair their ability to work on the job?
A No, ma'am. That's nothing -- they're not my employees.
Q Okay. But if they're working as a sub on one of your jobs, don't you think you have a duty to make sure that you're selecting an independent contractor --
A No, ma'am. That's between them. I'm not required to do that. They're not my employees. That would be like me coming to your office and saying, "I'm going to give a urine test to your secretary because she's typing my pleadings."
